Kaivan P. Mangouri

Kaivan P. Mangouri

Kaivan Mangouri's practice revolves around general civil litigation and transactional matters with representation of individuals and small businesses.  He has deep experience in personal injury, business disputes and a range of professional liability matters.

Kaivan has defended and pursued a variety of claims on behalf of licensed contractors, homeowners, developers, commercial landlords and tenants. In addition to the courtroom, this experience spans the full spectrum of building trades in other forums, including mediation, arbitration, and administrative hearings before the Arizona Registrar of Contractors (ROC). His professional liability practice mainly focuses on pursuit of claims against insurance professionals, accountants, financial advisors, engineers, architects, healthcare professionals, and other professions regulated under state law.

Kaivan initially focused his practice in personal injury. He brings a wealth of experience in navigating claims, coverage issues, and the web of third-party interests that apply to settlements. Kaivan also conducts arbitrations and settlement conferences, so he is able to view cases from the informed position of a neutral, his clients' perspective and (from his other practice areas) that of the defense, to present cases in a manner that will resonate with mediators, arbitrators, judges and juries.

More recently, Kaivan has developed a probate litigation practice and draws on his legal education focusing on complex trusts and estates issues. This burgeoning practice often involves disputes that straddle his civil litigation practice, enabling him to handle both parts of the case. Kaivan also has experience in bankruptcy creditors rights, judgment enforcement, and pursuing claims under Arizona's fraudulent transfer statute.

Above all, Kaivan is committed to providing client-centered legal representation. His goal is to inform and educate his clients about the situations they find themselves in and the path he has laid out for resolution of their legal dispute or transactional engagement. Kaivan's litigation background enables him to draft and negotiate agreements with an eye toward how terms actually play out in a dispute. For business clients, this allows him to focus on what matters to close a deal in a cost-effective yet risk-cognizant manner.

Experience

Kaivan's notable cases include: representing a specialized engineering company against defunct business partner on breach of contract/trade secret theft and securing settlement from a Fortune 50 successor company; securing an injunction and judgment against a publicly-traded successor company in connection with fraudulent transfer of farmland; securing settlements under Arizona's consumer fraud statute; litigating and negotiating buyouts in closely-held company disputes; representation of a large commercial landlord in defense of injunction and litigation attempting to stop construction; securing six and seven figure settlements in personal injury and medical malpractice cases.
